Privacy Policy

This Privacy Policy applies to the LogiGear Corporation (“LogiGear”) online services (including the LogiGear website and mobile application), and any LogiGear or subsidiary online interface that links to this Policy, along with any software provided to you by LogiGear.

The term “LogiGear,” “we,” or “us,” or “our,” in this Policy refers to LogiGear and its affiliates (if any) that link to this Policy. This Policy describes how we may collect, use and share information from or about you, and explains how information may be collected and used for advertising purposes.

For visitors to the LogiGear website, users of the LogiGear services and software, we may use and share any information that we collect from or about you in accordance with the terms and conditions of this notice.  This Privacy Policy describes our practices in connection with information that we collect:

  • Through websites operated by us from which you are accessing this Privacy Policy (the “Websites”);
  • Through the software applications made available by us for use on or through computers and mobile devices and in connection with which you are accessing this Privacy Policy (the “Software”);
  • Through email messages that we send to you that link to this Privacy Policy

Collectively, we refer to the Websites, Software, and email messages as the “Services.”

Personal Information

Personal Information” is information that identifies you as an individual or relates to an identifiable individual, and can include (but is not necessarily limited to) any of the following:

  • Name;
  • Postal address;
  • Telephone number;
  • Email address;
  • Bank account details;
  • Date of birth;
  • Job titles and roles;
  • Profile picture;
  • Social Security number;
  • Social media account ID;
  • Username and password.

How We Collect Personal Information

We and our service providers collect Personal Information in a variety of ways, including (but not limited to):

  • Through the Services
    • We may collect Personal Information through or related to the Services, such as when you sign up for or use a LogiGear account.
  • Through Use of the Website
    • When you visit our website, the following information may be collected and stored until deleted:
      • Your computer’s IP address; date/time of access; the names of the pages you visited; Your browser’s operating system.
  • Offline
    • We may collect Personal Information from you from a variety of offline sources, such as when you contact customer service, or when you provide us with information at events such as conferences and trade shows.
  • From Other Sources
    • We may also collect your Personal Information from other sources, such as:
      • Publicly available databases; and
      • Marketing and advertising partners.
    • Why We Collect Your Personal Information:
      • Personal Information is collected to provide you with the Services to provide a proper connection to Our website, to ensure an appropriate user experience, to evaluate system security and stability, and for further administrative purposes. If we request information from you and you do not provide that information, we may not be able to provide you with the Services. Note that if you disclose any Personal Information relating to other people in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy. 
    • Use of Personal Information
      • We and our service providers use Personal Information for legitimate business purposes, including (but not limited to):
      • Providing the functionality of the Services and fulfilling your requests.
        • Giving you secure access to your account, including managing your username and password;
        • Providing you with the functionality associated with your account;
        • Responding to your inquiries and fulfill your requests;
        • Providing you with appropriate customer service.
        • Providing you with general administrative information, such as changes to our terms, conditions, and policies.

We will engage in these activities to comply with our contractual and other legal obligations. 

  • Providing you with our newsletter and/or other marketing materials and facilitating social sharing.
    • Sending you marketing materials such as emails to tell you about our services, new products, and other news about our company.

We will engage in this activity with your consent, or where we have a legitimate interest.

  • Analyzing Personal Information for business reporting and providing personalized services.
    • To analyze or predict your preferences, to aggregate information for advertising, reporting, and business-related analysis;
    • To personalize our interactions with you, and to provide you with information and/or offers tailored to your interests;
    • To better understand your preferences so that we can deliver content via our Services that we believe will be relevant and interesting to you.

We will provide personalized services either with your consent or because we have a legitimate interest.

  • Aggregating and/or anonymizing Personal Information.
    • We may aggregate and/or anonymize Personal Information so that it may no longer be considered Personal Information. We do so to generate other data for our use, which we may use and disclose for advertising, marketing, business analysis, technical analysis, communication with you, communication with third parties, including service providers, and any other legitimate or legal business purpose, including but not limited to any of the following:
      • Data analysis to improve the efficiency of our Services;
      • Audits to verify that our internal processes function as intended and are compliant with legal, regulatory, or contractual requirements;
      • Fraud and security monitoring, such as to detect and prevent cyberattacks or attempts to commit identity theft;
      • Developing new products and services;
      • Enhancing, improving, or modifying our current products and services;
      • Identifying usage trends, such as understanding which parts of our Services are of most interest to users;
      • Operating and expanding our business activities, including understanding which parts of our Services are most interesting to you and others; and

We engage in these activities to and fulfill manage our contractual relationship with you, to comply with a legal obligation, and/or because we have a legitimate interest.

Disclosure of Personal Information

  • We may disclose Personal Information to our affiliates and business partners as detailed below to effectuate the purposes described in this Privacy Policy, including the uses described above.
    • To our third-party service providers, to facilitate services they provide to us.
      • These third-party service providers can include providers of services such as website hosting, data analysis, payment processing, information technology, network, and related infrastructure provision, customer service, email delivery, auditing, and other services.
    • To other third parties, to permit them to send you marketing communications, consistent with your choices.

Other Uses and Disclosures

We also use and disclose your Personal Information as necessary or appropriate, especially when we have a legal obligation or legitimate interest to do so:

    • This can include laws outside your country of residence.

    • These can include authorities outside your country of residence.

    • We have a legitimate interest in disclosing or transferring your Personal and Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings). Such third parties may include, for example, an acquiring entity and its advisers.

Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual. Such information includes, but is not limited to:

  • Browser and device information;
  • Software-usage data;
  • Information collected through cookies, pixel tags, web beacons, clear GIFS, and other technologies;
  • Demographic information and other information provided by you that does not reveal your specific identity;
  • Information that has been aggregated in a manner such that it no longer reveals your specific identity.

If we are required to treat Other Information as Personal Information under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Information as detailed in this Privacy Policy.

Collection of Other Information

We and our service providers may collect Other Information in a variety of ways, including (but not limited to):

  • Through your browser or device.
    • Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, and Internet browser type and version. We use this information to ensure that the Services function properly. 
  • Through your use of the Software.
    • When you download and/or use the Software, we and our service providers may track and collect Software usage data, such as the date and time the Software on your device accesses our servers and what information and files have been downloaded to the Software based on your device number.
  • Using cookies.
    • Cookies are pieces of information stored directly on the device you are using. Cookies allow us to collect information such as browser type, time spent on the website, pages visited, language preferences, and your relationship with us. We use the information for security purposes, to facilitate navigation, to display information more effectively, to personalize/tailor your experience while engaging with us (including providing you with advertising), and to recognize your device to allow your use of our online products and services. We collect statistical information about the usage of the Services to continually improve the design and functionality, to understand how account holders and visitors use the Services, and to assist us with resolving questions regarding the Services.
      • You can refuse to accept these cookies and most devices and browsers offer their own privacy settings for cookies. You will need to manage your cookie settings for each device and browser you use. If you do not accept these cookies, however, you may experience some inconvenience in your use of the Services and some online products and services. For example, we will not be able to recognize your device and you may need to answer a challenge question each time you log on.
      • Cookies are typically stored on your device for a predetermined period of time, typically 30 days. If you visit our site again to use the Services during that time period, the site will automatically recognize that you have been with us and what inputs and setting you have made, so you do not have to re-enter those setting. 
    • Using pixel tags and other similar technologies
      • We may use pixel tags (also known as web beacons and clear GIFs) to, among other things, track the actions of users of the Services, measure the success of our marketing campaigns, and compile statistics about usage of the Services and response rates.
    • IP Address
      • Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the pages visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications, and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, and administering the Services. We may also derive your approximate location from your IP address.

Web Analytics

Web analytics are used for the continuous optimization of our website. The tracking provides a statistically record of the use of our website and to evaluate it for the purpose of optimizing our offer to you. From time to time, we employ data processing and collection services and tools to help us provide you with the best services available.  An example of a web analytics service is Google Analytics. For more information on the analytics services we employ, please contact us directly. The legal basis for the data processing described in the following section is our authorized interest in the needs-based design and continuous optimization of our website.

Security

To protect Personal Information from unauthorized access and use, we use security measures that comply with applicable federal, state, and other relevant local laws, and with industry appropriate practices. These measures may include device safeguards and secured files and buildings as well as oversight of our third-party service providers to ensure information remains confidential and secure. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately.

Choices and Access

Your choices regarding our use and disclosure of your Personal Information

We give you choices regarding our use and disclosure of your Personal Information for marketing purposes. You may opt out from:

  • Receiving electronic communications from us: If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by following the instructions contained in each such email.
  • Our sharing of your Personal Information with affiliates for their direct marketing purposes: If you prefer that we discontinue sharing your Personal Information on a going-forward basis with our affiliates for their direct marketing purposes, you may opt out of this sharing by contacting [email protected].

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.

Additional Rights

The law places robust obligations on entities in the protection of personal data. The way we protect your personal data reflects our legal obligations. A number of rights in relation to the use of your personal information empowers you to make certain requests of us, detailed as follows:

(a) Requesting a copy of your personal data

You can access the personal data we hold about you and exercise your right to have a copy provided to you, or someone else on your behalf, in a digital format by emailing or writing to us using the contact details set out below.

(b) Letting us know if your personal data is incorrect

If you think any of the personal data we hold about you is incorrect, please let us know by contacting us. We will check the accuracy of the information and take steps to correct it if necessary.

(c) Asking us to stop using or to erase your personal data

You have the right to object to our use of your personal data. You can ask us to delete it, to restrict its use, or to object to our use of your personal data for certain purposes such as marketing. If you would like us to stop using your data in any way, please get in touch. If we are still providing services to you, we will need to continue using your information to deliver those services. In some circumstances we are obligated to keep processing your information for a set period of time. Information will generally be provided to you free of charge, although we can charge a reasonable fee in certain circumstances.

(d) Asking us for a copy of your personal data

You have the right to request from us a copy of your personal data, which will be provided to You in a structured, standard and machine-readable format.

(e) Revoke consent

You may revoke your once-given consent at any time.  If you revoke your consent, we will refrain from using your data to the extent required by law.

(f) Storage time

We typically store personal data only as long as necessary to fulfill our contractual or legal obligations. Thereafter, we delete the data, unless we need the data until the expiration of the statutory limitation period for evidence for civil claims or for statutory storage requirements.

We typically retain contract information for three years from the end of the year in which the business relationship ends with you.

We sometimes save your data for accounting and tax reasons. We are obliged to do so because of legal documentation obligations that may arise under the law. The deadlines for storing such documents are from two to ten years.

(g) CCPA

The California Consumer Privacy Act (CCPA) places new obligations on organizations that collect personal information of California consumers. As a result, we are updating our Privacy Policy to include a description of additional rights granted by CCPA and provide California consumers with required disclosures about the collection of personal information.

(h) Your California Privacy Rights

This section provides additional details about the personal information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA.”

For more details about the personal information we have collected over the last 12 months, including the categories of sources, please see the relevant sections, above. We collect this information for the business and commercial purposes described above. We share this information with the categories of third parties described above (as such term is defined in the CCPA). We do not sell your personal information; and will not sell your personal information without providing you the ability to opt out. Please note that we do use third-party cookies for our advertising purposes as further described above.

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of personal information we collect (including how we use and disclose this information), to delete their personal information, to opt out of any “sales” of their personal information that may be occurring, and to not be discriminated against for exercising these rights.

In your request, please make clear what Personal Information you would like to have changed or whether you would like to have your Personal Information removed from our database. For your protection, we may only implement requests with respect to the Personal Information associated with the email address that you use to send us your request, and we may need to verify your identity before implementing your request. Please note that we may need to retain certain information for record-keeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion.

Retention Period

We retain Personal Information for as long as needed or permitted based on the purpose(s) for which it was obtained and consistent with applicable law.

The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide the Services to you (for example, for as long as you have an account with us or keep using the Services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is appropriate under the law (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

Third-Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

In addition, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, Blackberry, or any other Software developer, Software provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer.

Use of the Services by Minor

The Services are not directed to individuals under the age of sixteen (16), and we do not knowingly collect Personal Information from individuals under 16.

Jurisdiction and Cross-Border Transfer

Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using the Services, you understand that your information will be transferred to countries outside of your country of residence that may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in those other countries may be entitled to access your Personal Information.

Sensitive Information

Unless we request it, we ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Services or otherwise to us.

Updates to This Privacy Policy

The “Last Updated” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy.
